Prof Birgit Kuschke

Position, academic and professional qualifications

Professor Birgit Kuschke graduated with the degrees BLC (cum laude) in 1986 and LLB (cum laude) in 1988 from the University of Pretoria and the LLD degree in 2009 at the University of South Africa. Kuschke holds a C2 NRF-rating as researcher.

She is a practising attorney, notary, and conveyancer of the High Court of South Africa (admitted in 1994) and practised for her own account from 1994 until 2005 and resumed her attorneys practice from September 2020. As a practising attorney she lectures Drafting of Contracts for candidate attorneys at the Law Schools presented under the auspices of the Law Society of South Africa.

Kuschke served as Deputy Dean: Teaching and Learning of the Faculty of Law from 1 July 2018 until 2019, as Acting Dean (ad hoc) and is currently an Associate professor in the Department of Mercantile Law and a co-Director of the Unit for Insurance Law and Governance.

Areas of specialisation

Kuschke specialises in insurance law; engineering and construction law; general law of contract; law of delict; and legal and commercial aspects relating to project management. She lectures on these topics in various undergraduate and postgraduate modules.

Academic and professional experience and memberships

She conceptualised and implemented the module on Legal Aspects in the internationally accredited m\Master’s degree in Project Management (MPM) still presented in the Faculty of Engineering, Built Environment and Information Technology of UP.

She has conceptualised and lectured the module Legal Aspects of Project Management in the Programme in Project management (PPM) since its inception in 1997.

Prof Kuschke serves as the Vice-President: Academic of the International Insurance Law Association since 2018 and is a member of two of its Working Groups: the Pollution, Products and New Technologies and the Consumer Protection and Dispute Resolution Working Groups.

Kuschke is a Corresponding Member for the drafting of the “Principles of European Insurance Contract Law” (‘PEICL Team’) and a principal drafting member of the international Drafting Committee of the universal Principles of Reinsurance Contract Law (known as ‘PRICL’). 

She has contributed widely to national and international books, journals, and conference proceedings, and served as an editor of 4 academic books.

The PPM is recognized by the following:

  1. PMI (Project Management Institute) – USA and Globally
  2. ECSA (Engineering Council of SA)
  3. SACPCMP (South African Council for the Project and Construction Management Professions)
  4. SACNASP (South African Council for Natural Scientific Professionals)
  5. PMSA (Project Management South Africa)

On successful completion of the PPM, suitable candidates may be eligible to apply for the professional designation of Project Manager (PM) conferred by Project Management South Africa (PMSA). PMSA is the SAQA recognized professional body representing the interests of project managers across sectors.
